Military Defense
The Military Defense specializes in the defense of soldiers in military-criminal law, and consists of dozens of enlisted defense lawyers working in each district of the Military Courts, as well as numerous lawyers serving in reserve duty. The military defenders handle thousands of cases annually dealing with a variety of offences in the military justice system, and assist soldiers and commanders throughout legal and related proceedings.
The Military Defense has significant experience in all matters of military law, and handles a wide array of cases, including complex and sensitive ones. The work done by the Military Defense has left an indelible mark on the State of Israel's criminal and constitutional law.
The Military Defense provides legal advice in real-time, every day of the week and at all hours of the day, including weekends and holidays. A soldier, non-commissioned officer or commissioned officer being investigated by the Military Police or by the Israel Police may request to consult with a defense lawyer, and is entitled to such advice both before and during an investigation from a lawyer of his or her choosing. Such a person may also request a military defender, whose services will be provided at no cost. The Military Defense will continue to represent the soldier in the Military Courts if an indictment is filed against them, or if their arrest is requested.
The Military Defense enjoys full professional independence. In accordance with IDF directives, a military defender, when fulfilling his or her duty, is not subject to anyone except the immediate commander, and must act only in the defendant's best interests.
The Military Defense operates pursuant to a deep sense of service, commitment, and an understanding of the difficulties involved in facing criminal investigations and legal proceedings. At all times, the Military Defense prioritizes assisting any soldiers undergoing criminal investigation or facing trial, as well as their families, with the purpose of providing professional representation, of obtaining the best results for them, of listening to and advising them, and assisting with their return to daily life.
The Military Defense also advances different initiatives in order to strengthen the protection of the rights of soldiers in criminal proceedings in the military justice system. The Military Defense promotes the rights of solders in criminal-military law by developing fundamental arguments, appealing to administrative instances, filing petitions to Israel's Supreme Court sitting as the High Court of Justice, and more.
Through individual cases as well as the advancement of different initiatives, the Military Defense assists soldiers under investigation and under trial, furthers the rights of soldiers, and contributes to the pursuit of justice. This is all done unwaveringly, independently and tirelessly.
